In 1993 Congress passed the Family Medical Leave Act which is codified at 29 U.S.C. §§ 2601-2654. The Act requires employers with 50 or more employees to provide the employee 12 weeks of leave per year for birth or adoption of a child, to care for a sick family member or leave for an employee with a serious health condition. The Act defines health condition as an “illness, injury, or impairment or physical or mental condition”. The condition must involve either continuing treatment by a provider or inpatient care.
