A ruling by the Supreme Court of New Jersey which held that contingency fees must be scheduled according to the size of the award, with the percentage of the award going to the claimant’s lawyer declining as the size of the award increases. For example, in New Jersey, lawyers may receive 50 percent of a $1,000 settlement but only 10 percent of any amount recovered over $100,000. A number of States have adopted variations of the New Jersey rule.
